Description:
File a claim for damages against the State for incurred property damages or personal injury due to the negligence of a state employee or state official. Must give written notice of the claim to the Division of Claims and Risk Management. Written notice of claim should include any facts and details that are relevant to the claim. Must also provide documentation to support your demand for damages. Division of Claims Administration has ninety (90) days from the date of receipt of a claim to investigate and either approve or deny the claim. You must file a claim within one year for bodily injury; and within three years for property injury.
Some of the most common types of claims are:
- Negligent operation of a state vehicle or machinery
- Negligent condition on state property
- Negligently created or maintained condition on a state highway
- Negligent care, custody and control of persons or personal property
- Professional malpractice
- Breach of contract
